What Is a Guardianship?
A guardianship is a legal relationship where one person (the guardian) is appointed by the court to make decisions for another person (the ward). When a guardian is appointed, they are given the power to decide for the ward.
These decisions may include:

You can establish guardianship by creating a durable power of attorney. A power of attorney is a legal document that gives someone else the power to make decisions on your behalf. A durable power of attorney is a power of attorney that remains in effect if you become incapacitated.
When you create a durable power of attorney, you can name a specific person as your guardian. If you become incapacitated and a guardian is needed, the court will appoint the person named in the power of attorney as the guardian. The guardianship process is simpler and less expensive than the probate process.
